Trademark complaints based on third party advertising
The ads found on this site are not generated by Com.com, but, rather, are generated by third-party advertising partners.
If you believe that your trademark rights have been violated, please send an e-mail to [email protected] containing the following information:
1. Your name, address, telephone number, and email address;
2. A copy of your trademark registration, or list the trademark(s) at issue, the country/countries where registered, and the registration number(s);
3. A screenshot and description of the alleged infringement;
4. A statement by you that you have a good faith belief that the disputed use is not authorized by the trademark owner, its agent, or the law;
5. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the trademark owner or authorized to act on the trademark owner's behalf;
6. Your signature
We will promptly review complaints of alleged trademark infringement and perform an investigation within five (5) business days. If our investigation determines that the advertisement is in fact violating your trademark rights we will put in a reasonable effort to ensure that the third-party advertiser no longer violates these rights.
Information for Trademark Owners
We anticipate questions from trademark holders regarding users reaching our site through third level domains of Com.com that are identical or similar to valid trademarks. The below points many help answer some of these questions:
First, third level domains are not covered by the ACPA because they are not "registered with or assigned by any domain name registrar."
Second, our wildcard function processing a trademarked input does not constitute a "use" in "sale or advertising" of services. The wildcard function does not handle the third-party user's trademark input as a trademark, but merely as a web address that is redirected internally.
Third, our site is not similar to that of any trademark holder and we make a clear and reasonable effort to show that we are in no way affiliated with any trademark that is imputed as a third level domain of Com.com. As such, there is a very low risk of consumer confusion.
